Often, when parties realise that a legal dispute has arisen due to, say, the performance or interpretation of any agreement, they automatically think of litigation in court.

The inevitable war-cry is “let’s take them to court”. Litigants and lawyers alike take it for granted that the most efficient way of resolving a dispute is to file a process in our formal courts. It is not.
As good legal and business practice, room should always be made for alternative dispute resolution mechanisms to find viable working solutions for all parties involved.
