LEGAL MATTERS: Issues around resigning with immediate effect

Resignation is a common occurrence. The reasons vary widely. This week, however, I will deal with employees looking to resign with immediate effect. The reasons for this, too, are many.

One of the more common reasons is that the employee is faced with imminent disciplinary proceedings and, rather than risk dismissal and blemishing their record, they prefer to up and leave.
The position of the law is clear in this regard. An employee can resign at any time with or without notice. This was emphasised in the case of Madondo vs. Conquip Zimbabwe (Pvt) Ltd SC 25/16.
